PCB 10 [10-May-1991] STATE OF VERMONT PROFESSIONAL CONDUCT BOARD In re: PCB Files No. 87.86, 86.50 and 86.04 NOTICE OF DECISION PCB 10 Procedural History Two parties filed complaints with the Professional Conduct Board alleging that the respondent, a member of the Vermont Bar, improperly had become personally involved with client and had represented adverse parties in a matter. Bar Counsel investigated the complaints and, in the course of the investigation, also investigated additional allegations, including that the respondent had filed litigation in the name of a non-existent person. After investigation, Bar Counsel recommended that a charges be dismissed because the allegations cannot be proved by clear and convincing evidence, the standard of proof is required in professional conduct matters. Notice of Decision The Professional Conduct Board reviewed the recommendations of Bar Counsel and accepted them. Accordingly, the complaints are dismissed.
